MCX Tech Pty Ltd – Terms & Conditions of Trade

These Terms & Conditions govern all Goods and Services supplied by MCX Tech Pty Ltd (ABN 87 694 093 671). By engaging MCX Tech, you agree to be bound by these Terms.
1. Our Role
MCX Tech operates as a reseller and technical service provider.
We:
- Supply equipment, parts, and systems
- Provide installation, integration, and support
We do not manufacture products and do not control manufacturer performance or specifications.
2. Pricing & Quotes
- All pricing is subject to formal quotation
- Prices exclude GST unless stated
- Additional costs (freight, travel, installation) may apply
Pricing may change due to:
- supplier pricing changes
- exchange rates
- site conditions or scope changes
3. Payment Terms
Payment terms will be outlined on your invoice or quote and may include:
- 30-day accounts (approved customers)
- 7-day terms
- payment prior to delivery
We may require deposits or milestone payments.
4. Delivery & Risk
- Risk transfers upon delivery or collection
- MCX Tech is not responsible for shipping delays or third-party carriers
5. Installation & Services
We provide services with reasonable care and skill.
However, we do not guarantee:
- system compatibility beyond manufacturer specifications
- operational performance or outcomes
Customers must:
- provide safe site access
- ensure equipment suitability
- follow all operating instructions
6. Product Use & Operator Responsibility
Many systems rely on:
- GPS signals
- connectivity
- environmental conditions
We do not guarantee accuracy or uptime.
Operators remain fully responsible for the safe operation of all equipment at all times.
7. Warranty
- Products are covered by manufacturer warranties only
- MCX Tech does not provide additional warranties
8. Limitation of Liability
To the maximum extent permitted by law, MCX Tech is not liable for:
- loss of profits
- crop or yield loss
- downtime
- indirect or consequential loss
Our total liability is limited to:
- the value of the Goods/Services, or
- available insurance coverage
9. Customer Responsibilities
Customers must:
- provide accurate information
- ensure safe working conditions
- follow all instructions and guidelines
Additional costs may apply where delays or variations occur.
10. Variations & Cancellations
- Changes to scope may affect pricing and timelines
- Deposits are non-refundable once goods are ordered
- Cancellation may incur full cost recovery
11. Data & Technology
Systems may involve third-party platforms and data transmission.
MCX Tech is not responsible for:
- data loss
- outages
- third-party system failures
12. Disputes
- Must be raised in writing within 7 days
- Undisputed amounts must still be paid
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
14. Australian Consumer Law
Nothing in these Terms excludes your rights under the Australian Consumer Law.
